试论预防性环境公益诉讼重大风险认定

摘要：
面对新时期环境保护的现实需求，加强预防性司法救济的实践非常必要。重大风险作为预防性环境公益诉讼中的争议焦点，也是预防性司法救济实践的重要组成部分。在对2015年的云南安宁炼油案展开的预防性环境公益诉讼重大风险认定分析中发现，存在着配套程序与认定需求不匹配的问题，严重影响了重大风险认定工作的顺利展开。基于此，结合实际案例探索预防性环境公益诉讼重大风险认定的完善策略，对于推动国内环境保护公益诉讼工作的有序开展，维护公益诉讼程序公正具有重要意义。
On the Identification of Major Risks in Preventive Environmental Public Interest Litigation

Abstract:
In the face of the actual needs of environmental protection in the new era, it is very necessary to strengthen the practice of preventive judicial relief. As the focus of disputes in preventive environmental public interest litigation, major risks are also an important part of preventive judicial relief practices. In the analysis of the major risk identification of preventive environmental public interest litigation launched in the Yunnan Anning oil refining case in 2015, it was found that there was a mismatch between the supporting procedures and the identification requirements, which seriously affected the smooth development of the identification of major risks. Based on this, exploring a comprehensive strategy for identifying major risks in preventive environmental public interest litigation based on actual case practice is of great significance to promoting the orderly development of domestic environmental public interest litigation work and maintaining the fairness of public interest litigation procedures.
