数字经济的深入发展与互联网技术的广泛普及，使在线纠纷解决机制作为传统司法体系的重要补充，在多元纠纷解决体系中的作用日益凸显。人工智能与在线纠纷解决机制的深度融合，在提升纠纷解决效率的同时，也引发了算法不透明、数据隐私风险、责任认定困难等伦理与法律问题。以人工智能与在线纠纷解决机制融合过程中的伦理与法律约束为研究主题，阐述二者融合的理论基础，分析构建约束机制的必要性，进而提出具有操作性的伦理规范框架与法律规制路径。在此基础上，构建原则引导与实体规范相协调的治理体系，旨在为人工智能深度融入在线纠纷解决机制的规范发展提供理论依据，推动其在法治轨道上健康有序发展。
Ethical and Legal Constraints on the Integration of Artificial Intelligence in Online Dispute Resolution

Abstract:
With the in-depth development of the digital economy and the widespread of Internet technology, online dispute resolution mechanism, as an important complement to the traditional judicial system, plays an increasingly prominent role in the diversified dispute resolution system. While integration of artificial intelligence and online dispute resolution mechanisms has improved the efficiency of dispute resolution, it also leads to ethical and legal issues such as algorithm opacity, data privacy risks, and difficulties in determining responsibility. Focusing on the ethical and legal constraints on the integration of artificial intelligence in online dispute resolution, this article elaborates on the theoretical basis of the integration of the two, analyzes the necessity of constructing constraint mechanisms, and proposes an operational ethical normative framework and legal regulatory path. On this basis, the study aims to construct a governance system that coordinates principle guidance with entity norms, provide theoretical basis for the standardized development of artificial intelligence's integration into online dispute resolution mechanisms, and promote its healthy and orderly development on the track of the rule of law.
