纠纷解决视角下居住权制度理解与适用

摘要：
居住权制度作为一项重要的法律制度创新确立于《民法典》中，但由于立法意旨与法律架构相矛盾、理论认识不准确、配套措施不完善等原因，涉居住权纠纷的处理呈现无序性特征。对此，宜分类研究解决涉居住权纠纷，通过对居住权设立与效力的分析，适用物权与债权区分原则，准确理解和完善居住权登记制度，从而解决居住权合同纠纷；深入对居住权行使与限制的研究，厘清所有权与居住权的权利内涵界分，准确认识居住权权利主体、义务承担和权利救济等重要问题，从而解决居住权纠纷。
Understanding and Application of Residential Right System from the Perspective of Dispute Resolution

Abstract:
The system of residence rights, as an important legal innovation, is established in the Civil Code. However, due to the contradiction between legislative intent and legal framework, inaccurate theoretical understanding, and incomplete supporting measures, the handling of disputes related to residence rights presents a disorderly feature. In this regard, it is appropriate to study and solve the disputes related to the right of residence by classification. Through the analysis of the establishment and effectiveness of the right of residence, the principle of distinguishing property rights from creditor's rights should be applied to accurately understand and improve the registration system of the right of residence, so as to solve the contract disputes of the right of residence. Indepth study should be carried out on the exercise and restriction of the right of residence, to clarify the right connotation boundary between ownership and right of residence, accurately understand the right subject, obligation commitment and right relief of the right of residence, and thus to solve the dispute over the right of residence.
