新型创作物的著作权保护问题研究

摘要：
技术的发展催生了各种新型表达方式的出现，而新型创作物的著作权保护问题已经成为普遍关心的问题。针对新型创作物的著作权纠纷应该根据《著作权法》第三条的规定对创作物是否构成作品进行认定，但需要注意的是，并不是所有的智力创作成果都有用著作权法进行保护的需要并且可以现实地获得保护，法院对新型创作物进行作品认定时应综合考虑，采取审慎的态度。多方因素衡量后应当纳入著作权法保护的新型作品的具体类型问题，可以通过对现有作品法定类型适当的扩大理解将其涵盖，无法涵盖的则将其纳入“其他作品”中予以个案救济，法官在解决纠纷中无需创设新的作品类型。
Research on Copyright Protection of New Creations

Abstract:
The development of technology has given rise to the emergence of various new forms of expression, and the copyright protection of new creations has become a common concern. In view of the copyright dispute of new creations, it should be determined whether the creations constitute works according to the provisions of Article 3 of the Copyright Law. However, it should be noted that not all intellectual creations can be protected by copyright law and can be protected realistically. The court should consider comprehensively and adopt a cautious attitude when identifying new creations. The specific types of new works that should be protected by copyright law after weighing many factors can be covered by appropriately expanding the understanding of the legal types of existing works, and those that cannot be covered can be included in "other works" for individual relief. Judges do not need to create new types of works in resolving disputes.
