政府与市场视野下的特许经营信息披露制度

摘要：
自《商业特许经营管理条例》推行以来，中国的商业特许经营有了快速的发展与繁荣。但因为市场管理体系的不健全，我国商业特许经营在实际运营过程中面临着各种问题。而信息披露制度的不完善是造成各种问题的主要原因之一。以政府对信息披露之干预为切入点，厘清政府和市场的法律边界，完善披露规则、配套追责机制，提高监管效率同时利用中介制度和行业协会加强市场约束力，是完善商业特许经营信息披露制度的关键。
Franchise Information Disclosure System from the Perspective of Government and Market

Abstract:
China's commercial franchising has experienced rapid development and prosperity from the implementation of the Regulations on the Administration of Commercial Franchise. However, due to the imperfection of the market management system, China's commercial franchising has faced various problems. The imperfect information disclosure system is one of the main reasons for various problems. It is the key for improving the disclosure system of commercial franchise information to take the government's intervention in information disclosure as the starting point, clarify the legal boundary between the government and the market, improve disclosure rules, support accountability mechanisms, improve supervision efficiency and use intermediary systems and industry associations to strengthen market binding force.
